We will do everything we can to identify driver of the At Fault vehicle. For example if you have a registration number, we can make enquiries with DVLA to find out who is its registered keeper.

However sometimes despite your and our best efforts, it is impossible to put a name to the third party driver. In this situation you may be entitled to make a claim under the MIB Untraced Scheme.

If you have the correct name for the At Fault driver but the vehicle that he was driving was uninsured, your claim is dealt with under the MIB traced but Uninsured Drivers Agreement.

Although the MIB Uninsured Driver and MIB Untraced Scheme have some similarities, there are also important differences, so it is important for you to know whether your case is "MIB Untraced" or "MIB Uninsured Traced Driver".

The MIB Uninsured Traced Driver Scheme (see link in left margin) also applies where you have a valid name for the driver but we don't have his current address (such a driver is treated as a "traced" driver for MIB purposes.

The main features of the MIB Untraced Scheme are:

  • A claim is made by completing MIB's Application Form
  • We will guide you through the Claim Procedure
  • The claim is dealt with by MIB's Milton Keynes office
  • There are no Court Procedures involved
  • Any dispute with MIB is settled by an arbitration procedure
  • MIB make enquiries about the RTA, which can take a several months
  • MIB will pay compensation for your injuries
  • MIB sometimes pay for property/vehicle damage (see below)
  • MIB won't pay the first £300 of any  property damage claim
  • IMPORTANT you must report the RTA to the police IMMEDIATELY
  • IMPORTANT you must get a crime reference number
  • Time limits do apply for making an application (see below)
  • Use the MyAccident claim line and get 100% of MIB's award

Personal Injury and other losses directly resulting from personal injury (eg treatments costs, loss of earnings whilst off sick):

These are worked out and paid in the same way that a Court would have awarded compensation against the At Fault Driver and his insurers if he had been traced. A medical examination will be arranged with a local doctor who will prepare a report regarding your injuries.


Property related losses eg repair costs, insurance excess, towing charges, replacement hire charges, storage charges, damaged clothing etc:

These are only paid under the Untraced Scheme if, and only if, the At Fault vehicle can be properly identified. This usually means being able to prove its valid registration number. If the vehicle was abandoned at the scene or there is reliable evidence of its registration number, you may be able to claim for property related losses. IF YOU HAVE NO VALID REGISTRATION NUMBER FOR THE AT FAULT VEHICLE, YOU WILL NOT BE ABLE TO CLAIM PROPERTY RELATED LOSSES UNDER THE UNTRACED SCHEME.

Even if you do have the At Fault Vehicle registration number, MIB will not pay the first £300 of your Property Related Losses.

The good news is that you do not need the At Fault Vehicle registration number to claim for any personal injuries sustained!


Time Limits

You should report the RTA to the police immediately and get a crime reference number. If the accident caused damage to any property or any vehicle, the RTA should have been reported to the police within 5 days of the accident, if the accident caused injury but no damage to any property or vehicle, the RTA should be reported to the police within 14 days. You may need to be quite persistant, many police officers are reluctant to allow Hit & Run Accidents to be reported just to get a crime reference number! In this situation we suggest you make a note of the officer's name and badge number and date and time you reported the incident and then write a letter of complaint to the station inspector (keeping a copy for your records!).

If you want to claim for property related loss (eg vehicle repairs, excess etc) the claim must be submitted to MIB within 9 months of the RTA

Any claim to MIB for personal injury must be made within 3 years of the accident.
